Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

1. Ember Stationery: the online store operated by Emmely Dechesne and Berber Braam, located at Prins Bernardstraat 12, Burgum, the Netherlands.

2. Customer: any natural person who places an order with Ember Stationery.

3. Consumer: a customer who is not acting in the course of a profession or business.

4. Agreement: the agreement between Ember Stationery and the customer that is formed after an order has been accepted by Ember Stationery.

5. Product: all products offered through the Ember Stationery online store, including stationery, journal sets, stickers, scrapbook paper, and other creative journaling products.

Article 3 – Applicability

1. These Terms & Conditions apply to all offers, orders, and agreements between Ember Stationery and the customer.

2. These Terms & Conditions will be made available to the customer before or, at the latest, when the agreement is concluded.

3. By placing an order, the customer agrees to these Terms & Conditions.

4. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the purpose of the original provision.

Article 4 – The Offer

1. Ember Stationery describes its products as clearly and completely as possible.

2. Where relevant, product information may include details such as contents, dimensions, materials, colors, and quantities.

3. Product images are displayed as accurately as possible. Minor differences between images and the actual product may occur, for example due to differences in screen settings.

4. Obvious errors or mistakes in an offer do not bind Ember Stationery.

Article 5 – The Agreement

1. The agreement is concluded once the customer has placed an order and Ember Stationery has confirmed the order by email.

2. After placing an order, the customer will receive an order confirmation at the email address provided.

3. Ember Stationery reserves the right to refuse an order where there is a valid reason to do so, for example if a product unexpectedly becomes unavailable.

4. If a product that has already been paid for cannot be delivered, the customer will receive a refund of the amount paid for that product.

Article 6 – Prices and Payment

1. All prices are stated in euros and, where Ember Stationery sells to consumers, include VAT where applicable.

2. Any shipping costs will be clearly displayed before the order is completed.

3. Payment can be made using the payment methods offered during the checkout process.

4. Ember Stationery accepts the payment methods available through the online store at the time of purchase, with the exception of Google Pay and manual payments.

5. Orders will be processed once payment has been successfully received or confirmed by the selected payment provider.

Article 7 – Delivery

1. Ember Stationery currently delivers to countries within the European Union where delivery is available through the online store.

2. Orders are generally processed and shipped within 3 to 5 business days after the order has been received.

3. Actual delivery times after shipment may vary by country and depend on the selected shipping service and destination.

4. Delivery times stated on the website are estimates. Delays by the carrier may result in an order being delivered later than expected.

5. Ember Stationery will do its best to process and ship orders as quickly as possible.

6. If an order experiences an unexpected delay before shipment, the customer will be informed as soon as reasonably possible.

7. For sales to consumers, the risk of loss or damage to the product transfers to the consumer when the product has been received by the consumer or by a third party designated by the consumer.

Article 8 – Right of Withdrawal

1. For online purchases, consumers have the statutory right to withdraw from the agreement within 14 days of receiving the product without giving a reason.

2. The consumer can exercise this right by contacting Ember Stationery within the withdrawal period at emberstationery@hotmail.com.

3. After notifying Ember Stationery of the withdrawal, the consumer generally has an additional 14 days to return the product.

4. The consumer is responsible for the direct costs of returning the product, unless otherwise required by law.

5. The consumer must handle the product and its packaging with care. The consumer may use and assess the product only to the extent necessary to determine its nature, characteristics, and functioning.

6. If the product has been used beyond what is necessary for such an assessment, the consumer may be liable for any resulting decrease in value.

Article 9 – Returns and Refunds

1. For the practical conditions and procedure regarding returns, please refer to Ember Stationery's separate Return Policy.

2. After a valid withdrawal, Ember Stationery will refund the payments received, including the costs of the original standard delivery.

3. If the consumer chose a more expensive shipping method than the cheapest standard delivery option, the additional costs will not be refunded.

4. Ember Stationery may wait with the refund until the product has been received or until the consumer provides proof that the product has been returned, whichever occurs first.

5. Refunds will be made using the same payment method used for the original payment, unless the consumer expressly agrees to another method.

Article 10 – Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to products that fall under a legal exception.

If Ember Stationery sells products for which an exception applies, this will be clearly stated with the relevant product before the purchase is made.

Article 11 – Statutory Warranty and Conformity

1. Ember Stationery guarantees that the products delivered conform to the agreement and meet the reasonable expectations a consumer may have of the product.

2. If a product does not conform to the agreement under normal use, the consumer may contact Ember Stationery.

3. If a defect is attributable to Ember Stationery, we will provide an appropriate solution within the applicable legal framework, such as repair, replacement, or a refund.

4. These Terms & Conditions do not limit any statutory consumer rights.

Article 12 – Complaints

1. Complaints regarding an order or product can be submitted by email to emberstationery@hotmail.com.

2. When submitting a complaint, we recommend including the order number, a description of the issue, and, where relevant, photographs of the product.

3. Ember Stationery will make every effort to handle complaints as quickly as possible and will provide a substantive response within a reasonable period.

4. If a complaint cannot be resolved to the customer's satisfaction, the consumer retains all statutory rights.

Article 13 – Liability

1. Ember Stationery is not liable for damage resulting from the use of products in a manner that could not reasonably have been foreseen.

2. This provision does not exclude or limit liability where such exclusion or limitation is not permitted by law.

3. The statutory rights of consumers remain fully applicable.

Article 14 – Intellectual Property

1. All texts, images, designs, logos, and other content published by Ember Stationery on the online store are protected by intellectual property rights to the extent that such rights apply.

2. Such content may not be copied, distributed, or used commercially without the prior written permission of Ember Stationery.

Article 15 – Personal Data

1. Ember Stationery processes customers' personal data only to the extent necessary for, among other things, processing orders and payments, delivering products, providing customer service, and complying with legal obligations.

Article 16 – Applicable Law

1. Agreements between Ember Stationery and consumers are governed by Dutch law, insofar as permitted under applicable consumer protection law.

2. Consumers retain the protection of mandatory provisions of the law applicable in their country of residence.

Article 17 – Changes

1. Ember Stationery may amend these Terms & Conditions when necessary.

2. For agreements that have already been concluded, the Terms & Conditions that applied at the time the agreement was concluded will remain applicable.

3. The most current version of these Terms & Conditions will be published on the online store.
